Subject and Structure of the Terms

The terms for the purchase of a subscription or Group Course (the “Subscription”, the “Group Course”) to the inlingua International Ltd. (inlingua Global) online language learning program is outlined in these terms & conditions (the “Terms”). The contractual relationship between the user (the “User”) and inlingua International Ltd., Belpstrasse 11, 3007 Bern, Switzerland (“inlingua Global”) with respect to the subscription for the use of the inlingua Global online language learning services (the “Services”, or the “Site”) is governed by these Terms and the billing history thereto (the “Billing History”). Additionally, the User must adhere to the inlingua Global Terms of Use (the “Terms of Use of inlingua Global”, available at www.inlingua-global.com/terms-of-use/).

If the User subscribes to inlingua Global or buys a gift Subscription, the User unconditionally accepts to be bound by these Terms and the Terms of Use of inlingua Global.

Content of Services

The educational Services provided by inlingua Global are described on the website www.inlingua-global.com (the “inlingua Global Website” or the “Website”).

Place of Provision of Services

The use of the Services takes place exclusively online.

Use of Services

To access the Services, the User must register and book in accordance with the instructions as described on the inlingua Global Website. Each User will be assigned a personal login and password which allows the User to access the Services (the “User Profile”).

With the User’s personal login and password, the User can access the Services 24 hours a day, 7 days a week. inlingua Global and its providers may need to interrupt the Services or part of the Services for maintenance work. The User accepts any such temporary lack of access to the Services without any right to compensation whatsoever.

inlingua Global cannot be held responsible in any way in the case of difficulty in accessing the Services if the User does not have the minimum technical requirements as described on the inlingua Global Website at the User’s disposal.

Registration and Personal Profile

When registering online, the User agrees to provide true, accurate, up-to-date, and complete personal information as required in the registration form. In particular, the User agrees not to create a false identity. The User agrees to update as may be necessary from time to time the details given at the time of registration without delay.

The rights of access to and use of the Services are strictly personal and non-transferable. The User is recognized by an identifier and a password for which the User is entirely responsible. The User agrees to keep the constituent parts of the identifier secret and not divulge them to anyone.

When the User is asked for personal information, inlingua Global’s primary interest is to provide the User with more personalized service. inlingua Global respects the User’s privacy

and does not sell, rent, or trade the User’s name or personal details to other organizations or use them for marketing purposes except as outlined in this policy.

The User’s name, last name, username, password, e-mail, phone, gender, date of birth, country (code), city address, address 2, province, region, interface language (code), time zone, will be posted in the User’s profile (if provided), which will be available only to the administrator or a company supervisor.

Inlingua Global uses the collected information to:

  1. deliver the Services and products that the User has requested and tailor them to the User’s needs (billing, identification and authentication);
  2. manage the User’s account and provide the User with customer support;
  3. contact the User about the User’s use of the Services;
  4. make research;
  5. generally, improve the content and functionality of the Services and the Website;
  6. enforce inlingua Global’s terms and conditions;
  7. manage inlingua Global’s business;
  8. perform functions as otherwise described to the User at the time of collection.

Access to Personal Information

If the User’s personally identifiable information changes, or if the User no longer desires the Services, the User may correct or amend some of the User’s personal information by making the change on the User’s account information page. The User can ask to delete her/his Account by contacting inlingua Global’s customer support. If a user account is deleted upon request of the User, no refunds become due for Services not consumed. No user data can be retrieved at a later date. inlingua Global will retain the User’s information for as long as the User’s account is active or as needed to provide Services to the User, comply with inlingua Global’s legal obligations, resolve disputes, and enforce inlingua Global’s agreements. The User’s account remains active even if the User’s subscription to inlingua Global’s paid Services has expired.

User’s Right

The User has the right to obtain confirmation on whether inlingua is using the User’s personal data. The User therefore has the right to access the User’s personal data, correct inaccurate data or request its deletion when the data is no longer necessary for the purposes for which it was collected.

The User will be entitled to ask inlingua:

  • for access to a copy of the User’s personal data;
  • to correct, erase or restrict the processing of the User’s personal data;
  • to transfer the information the User has provided under contract or consent to another organization;
  • to stop the processing of the User’s information, by withdrawing the User’s consent.

If the User believes that the User’s data protection rights have been infringed, for instance:

  • excessive amounts of the User’s personal data are being collected;
  • the User has been refused access to the User’s personal data;
  • the User has been refused the right to rectify inaccurate or incomplete personal data;
  • the User is refused the right to block or erase inaccurate or irrelevant personal data;

then the User is entitled to lodge a complaint with a competent supervisory authority.

Access of User Information

Inlingua Global may provide the User’s personal information to third parties that provide Services to assist inlingua Global with its business activities such as processing the User’s payment or offering customer support. These third parties are authorized to use the User’s personal information only as necessary to provide these services to inlingua Global.

inlingua Global may provide the results of the User’s placement, progress and achievement tests, and the User’s activity results to create pedagogical reports for the inlingua Global trainer assigned to the User.

inlingua Global may also disclose the User’s personal information as required by law, such as to comply with a subpoena, or similar legal process and/or when inlingua Global believes in good faith that disclosure is necessary to protect inlingua Global’s rights, protect the User’s safety or the safety of others, investigate fraud, or respond to a government request.

inlingua Global may also disclose the User’s personal information to any other third party with the prior consent of the User to do so.

Third Party Providers

inlingua Global reserves the right to provide its courses and services through third-party providers, including inlingua Global certified partners. By accessing or using the Services, the User acknowledges and agrees that certain course offerings may be delivered or facilitated by these authorized third-party providers. These third-party providers have met inlingua Global’s certification requirements and adhere to inlingua Global’s quality standards.

Use of Cookies

Portions of this Website use Google Analytics, a web analytics service provided by Google, Inc. (”Google”). Google Analytics uses ”cookies”, which are text files placed on a computer, to help the Website analyze how Users use the Website. The information generated by the cookie about the use of the Website (including IP address) will be transmitted to and stored by Google on servers in the United States. Google will use this information for the purpose of evaluating the use of the Website, compiling reports on Website activity for the Website’s operators and providing other Services relating to the Website activity and internet usage. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google’s behalf. Google will not associate the IP address with any other data held by Google. The use of cookies may be refused by selecting the appropriate settings on the browser. By using this Website, the User consents to the processing of the User’s data by Google in the manner and for the purposes set out above. The User can deactivate Google Analytics by downloading and installing the Google Analytics Opt-out Browser Add-on.

Log Files

As is true with most websites, inlingua Global collects certain information automatically and stores it in log files. This information includes internet protocol addresses as well as browser, internet service provider, referring/exit pages, operating system, date/time stamp, and click stream data. Occasionally, inlingua Global may connect personal data to information gathered in inlingua Global’s log files, as necessary to improve the Services. Otherwise, inlingua Global mostly uses this information with no connection to individual Users, to analyze trends, administer the Website, or track usage of various features within the Website.

Payment and Fees in General

Only by purchasing a Subscription or a Group Course on the inlingua Global Website, the User will receive access to exclusive resources and features. Any fees in relation with the connection to the Website are the User’s responsibility. The price rates may change from time to time, or new rates may be established, with advance notice posted on the Website and given to Users through email. If necessary, the notice will include specifications how the Users can accept the changes. Changes in pricing take effect at the beginning of the Subscription period or at the beginning of a new Group Course that follows the date of the change in price. By continuing to use the Services after the price change takes effect, the User accepts the new price. The User has the option to reject a price adjustment by canceling the Subscription before the new price takes effect.

The User Profile of the inlingua Global Website and the Billing History always provide access to the purchase information of the User’s current courses (including details on the payment information and of the cancellation policy).

If the User’s Services includes trainer-led lessons, either in a group setting or privately, such sessions are provided on a ”use them or lose them” basis, which means that if the User has not utilized them by the end of the Subscription, the right to such lessons will expire without any right to obtain a refund.

Regarding the timely booking, renewal and cancellation of Subscriptions and Group Courses, the respective special conditions hereafter are applicable.

Trial Period

From time to time, inlingua Global may offer trial periods for a specified number of days without payment or at a discounted price (the “Trial Period”). inlingua Global may determine the User’s eligibility to participate in a Trial Period and, to the extent permitted by the applicable law, may withdraw or modify the User’s Trial Period at any time without notice and without liability.

Some Trial Periods require the User to provide payment details to start the Trial Period. By providing this information, the User agrees to be automatically charged for the Subscription on the first day after the end of the Trial Period, monthly or at other intervals of which inlingua Global notifies the User in advance. If the User does not wish to receive charges, the User must cancel the Subscription before the end of the Trial Period.

Shared Accounts

Only one User can be associated to each account. Users cannot share accounts or user data of their User Profile. Sharing the User’s account or the user data of the User Profile with others is not permitted and may result in course termination.

Refunds and Cancellations in General

Once a payment for a billing period has been made, no refunds will be issued. The User acknowledges and agrees that all payments made for the Subscription or Group Courses are non-refundable.

The cancellation of the Subscription is the sole responsibility of the User. inlingua Global is not responsible for any failure by the User to cancel the Subscription or Group Course in a timely manner. Regarding the form and timely notice of cancellation of Subscriptions or Group Courses, the respective special conditions hereafter are applicable.

In the event of such a cancellation, the User will not be entitled to a refund of any unused portion of the Subscription fees.

Special Conditions for Subscription-based Models

The following specific terms and conditions apply to inlingua Global’s private lessons (“Subscriptions”).

Access to inlingua Global’s Online Education Services requires an active Subscription to the inlingua Global platform.

Private lessons are only available to learners aged 18 and over. If a User is found to be under the age of 18 and attending a live private lesson, inlingua Global has the right to terminate any Subscription.

Trainers reserve the right to cancel or limit participation in private lessons if a User is under the age of 18, or exhibits offensive or inappropriate language, conduct, or dress.

Online private lessons may be recorded for educational purposes. By participating in the private lesson, the User allows inlingua Global to record and process videos (including images and/or audio) of these lessons. The User is allowed to turn off the camera and microphone during the lesson.

inlingua Global does not guarantee that video functionality will always be available. Access to videos may be suspended, temporarily or permanently, for technical or other reasons, or to comply with applicable laws and regulations.

If the User has any problems or questions regarding the Online Education Services, he can contact customer support at info@inlingua-global.com.

Private lessons must be booked at least 24 hours in advance. Lesson offers will be deducted when booking private lessons. To cancel or reschedule a private lesson, the User must submit a cancellation or rescheduling request. Cancellation or rescheduling requests must be submitted at least 24 hours prior to the scheduled class time to receive a refund of the coupon. Otherwise, the course voucher will expire without any right to a refund.

A 45-minute private lesson will only start if the User logs in for class 5 minutes prior to, or within the first 10 minutes after, the scheduled time. If the User does not log in within this period of time, the private lesson will be cancelled, and the course voucher will expire without any right to a refund.

Booking, Renewal and Cancelling of Subscription-based Models

Subscriptions will automatically renew at the end of the applicable Subscription period, unless the User cancels the Subscription prior to the end of the then-current Subscription period or the Subscription was purchased for a limited period.

If the User wishes to cancel the Subscription, the User must notify inlingua Global at least 48 hours prior to the start of the next month’s renewal date to avoid charges. The cancellation becomes effective on the day after the current Subscription period expires. The notice of cancellation must be provided in text form to be effective. Services already used will not be refunded. If the User wishes to receive a refund of any payments already made to inlingua Global before the end of the trial period, the User must contact customer support (see contact details below in Contact inlingua Global).

When processing a refund, inlingua Global will pay the refund using the same means of payment that was used to pay for the Subscription.

Timeframe for the Subscription

The duration of the Subscription is determined by the Billing History. The Subscription starts on the day of the first payment and lasts for a specific term (in general one month) after which it is automatically renewed for another term of the same duration.

Special Conditions for Group Courses

The following specific terms and conditions apply to inlingua Global’s Group Courses (“Group Course”).

Access to the inlingua Global’s online Group Courses requires an active Group Course on the inlingua Global platform.

Group Courses are only available to learners aged . If a User is found to be under the age of 18 and attending a live Group Course, inlingua Global has the right to terminate any Subscription.

Trainers reserve the right to cancel or limit participation in Group Courses if a User is under the age of 18, or exhibits offensive or inappropriate language, conduct, or dress.

The language level and its respective Group Course may be determined by inlingua Global’s adaptive language test. The adaptive language test is not mandatory. A suitable Group Course in terms of level cannot be guaranteed. Therefore, inlingua Global cannot be held accountable if the User is not placed in a suitable Group Course. However, the User can be placed in another Group Course by contacting customer support.

Online Group Courses may be recorded for educational purposes. By participating in a Group Course, the User allows inlingua Global to record and process videos (including images and/or audio) of such Group Course and make them available to other students of the Group Course under the terms of the course agreement and inlingua Global privacy policy. The User is allowed to turn off the camera and microphone during class.

inlingua Global does not guarantee that video functionality will always be available. Access to videos may be suspended, temporarily or permanently, for technical or other reasons, or to comply with applicable laws and regulations.

Placement in Group Courses is based on reasonable best efforts. inlingua Global reserves the right to cancel and reschedule a Group Course. In that case, inlingua Global will offer a suitable substitution.

Booking, Renewal and Cancellation of Group Courses

Payments to inlingua Global are due before the beginning of the course and will not be automatically renewed at the end of the applicable course period. If the User wishes to cancel the Group Course, the User must notify inlingua Global. The notice of cancellation must be provided in written form to be effective. Cancellations are effective immediately, unless the User gives notice of cancellation at a specific later date.

Group Course lessons cannot be cancelled or rescheduled by the User. Payment for Group Courses cannot be refunded.

If the User wishes to receive a refund of any payment already made to inlingua Global, the User must contact customer support (see contact details below in Contact inlingua Global). Services already used will not be refunded. When processing a refund, inlingua Global will pay the refund using the same means of payment that was used to pay for the Group Course.

After 7 days from registration, the purchased Group Course cannot be cancelled, and the full amount of the course fee must be paid according to the subscribed payment schedule. inlingua Global reserves the right to suspend, without prior notice, all or part of the Services for breach of the payment schedule.)

Timeframe for the Group Course

The term of the Group Course is determined by the course schedule.

Changes to Terms & Conditions

inlingua Global may change the Terms at its sole discretion. If inlingua Global makes changes to the Terms that inlingua Global considers substantial, inlingua Global will notify the User through customer support. By continuing to use the Services after these changes, the User acknowledges and accepts the changes. If the User is not satisfied with the modified Terms, the User may cancel the Subscription in accordance with the Terms.

Links to other Websites

The inlingua Global Website contains links to other websites. Inlingua Global is not responsible for the privacy practices of such other sites. inlingua Global encourages the User to be aware when leaving inlingua Global’s Website and to read the privacy statements of any Website that collects personally identifiable information. This privacy statement applies only to information collected by the inlingua Global Website.

Testimonials

inlingua Global may post User testimonials on the Website which may contain personally identifiable information. Publication of testimonials is subject to the User’s prior written consent. If the User wishes to have such testimonial removed, the User shall contact inlingua Global’s customer support.

Communications from the Website

The User may at any time unsubscribe from any promotional email sent from the inlingua Global Website, by simply clicking on the unsubscribe link included at the bottom of each such email.

inlingua Global will send to the User strictly service-related announcements when it is necessary to do so (e.g. for announcing a temporary suspension of the Services for maintenance).

The User may not opt-out of these communications, which are not promotional in nature. If the User does not wish to receive them, the User must deactivate the User’s Account.

Confidentiality – Protection of Personal Privacy

inlingua Global complies with the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) and the Swiss Federal Act on Data Protection which regulate the processing of personal data within the European Union and Switzerland.

inlingua Global makes all reasonable efforts to ensure that the Services put at the disposal of the User meet technical standards and security norms. To safeguard the confidentiality of the User’s personally identifiable information, inlingua Global and its partners utilize sophisticated security techniques and procedures, including daily security and vulnerability scans, software audits, firewalls, and data encryption (Secure Socket Layers). inlingua Global makes all reasonable efforts to protect data against loss and unauthorized access.

inlingua Global cannot be held responsible for any direct or indirect damage, accidents, compensation by way of sanction, secondary damage, particular damage, or any other prejudice whatsoever, in particular damage incurred because of loss of use or data relating to the use of the Services, nor delays relating to the use of the Website or the impossibility of using the Website.

If the User discovers an incorrect charge on the billing statement from inlingua Global, please contact inlingua Global customer support (see contact details below in Contact inlingua Global). The User must report such charge immediately to the credit card provider, in accordance with the credit card provider’s standard procedures.

Despite these security procedures and practices, as is the case with all computer networks connected to the internet, inlingua Global cannot guarantee the security of the User’s personal information or any other information provided over the internet and will not be responsible for breaches of security.

No method of transmission over the internet, or method of electronic storage, is 100 % secure. Therefore, inlingua Global cannot guarantee its absolute security.

Protection of Children’s Information

inlingua Global is committed to protecting the privacy of children. inlingua Global’s Websites are general audience sites and not designed or intended to attract children under the age of 18. inlingua does not knowingly collect or solicit personal information from any person under the age of 18, nor does inlingua send them requests for personal information.

Limitations and Indemnification

Except for willful intent or gross negligence, inlingua Global’s liability in relation to the Services is excluded to the fullest extent possible under the applicable law, and the User agrees to indemnify and hold inlingua Global harmless from and against any and all liability, claims and costs that inlingua Global may incur as a result of the User’s breach of the Terms.

Protection of Intellectual Property

The User hereby agrees that inlingua Global is the sole owner of the inlingua Global teaching materials and that the same, at all times, shall be and remain the sole and exclusive property of inlingua Global. The User does not acquire any right, title, interest or claim of ownership in such inlingua Global teaching materials by reason of using inlingua Global’s Services. The User agrees not to record and publish the online lessons.

Law and jurisdiction

These Terms are governed by and construed in accordance with the laws of Switzerland, without regard to the Swiss conflict of law provisions.

Any dispute arising under or in connection with these Terms is subject to the exclusive jurisdiction of the courts of Berne/Switzerland.
